ChartersCharter on Incorporating Acquired Rights (TUPE) into Contract Award ProceduresThe scope of this Charter is to seek to remove the uncertainties in TUPE and toprovide contractual solutions and certainty in circumstances where the application of current legislation creates doubt. This will ensure a level playing field for contractors bidding for service contracts, provide certainty and confidence, and reduce the risk of unnecessary disputes and litigation.
Debriefing CharterSince its establishment in 1995, FPP has addressed key issues highlighted by its members, which require urgent attention if public procurement markets are to operate openly and fairly in the Republic of Ireland and Northern Ireland. Debriefing of suppliers and improved communications between buyers and suppliers are recognised by all parties as being of paramount importance. This Charter is intended to meet the requirements of suppliers operating in a highly competitive and growing market, while offering contracting entities an acceptable framework within which they also can achieve continuous improvement. The Charter provides buyers and suppliers with simple guidelines, enabling them to work together in an atmosphere of mutual trust, while respecting each others' individual rights and obligations. As it encompasses the scope of the EC Directives, FPP believes that this policy document conforms fully with EC rules.
Ethics CharterBearing in mind the scale and value of expenditure involved in the public procurement market, the Form on Public Procurement has consulted with representatives of the public agencies and suppliers engaged in the marketplace, in order to seek a consensus on the appropriate ethical behaviour which should apply in transacting business.While it is recognised that good working relationships between buyers and suppliers are essential to the delivery of a quality public service, it is acknowledged that ethical standards must be maintained at all times and by all parties. The purpose of this Charter is to set appropriate boundaries for ethical behaviour, to be adhered to by all those involved in the procurement process.
